In Part 3, Pipeline Online begins examining the affidavits of 12-year-old child, podcaster and Manitoba farmer as well as Saskatchewan Environmental Society and Citizens for Public Justice who have filed for an injunction to stop Saskatchewan’s recently announced plants to rebuild its coal fleet in its tracks. Part 3 focuses on the child activist’s affidavit.
The Parties:
The injunction to stop the rejuvenation of Saskatchewan’s coal-fired power generation fleet is being brought forward by three individuals and two environmental organizations. “This is not a class action. A class action is something different,” said Glenn Wright, the Saskatoon professional engineer-turned lawyer who is lead counsel on the case, working on a pro-bono basis.
Wright is an associate with Saskatoon law firm Procido LLP, founded by Chad Eggerman. Both have run unsuccessfully for political office in recent years. Wright has run as an New Democrat provincially and federally a total of three times from 2011 to 2016, an independent federally in 2019, and for the Green Party of Saskatchewan in 2020. Eggerman was the federal Liberal candidate for Saskatoon-West in 2025.
“This is a pro bono kind of endeavor that I’m doing on principle, not because I want to make money,” Wright told Pipeline Online.
Asked how the applicants came together, Glenn Wright said, “I’ve been active in organizing in the environmental space for more than a decade, and I’ve had people approach me asking me to sue the government on its continued use of coal fire power for a long time. And I haven’t been able to do that because there hasn’t been a reviewable decision that I’ve seen published or put forward by the government.
“So when this letter came out, my phone was ringing off the hook, and I had all kinds of people messaging me and asking me to do something about this. So it was actually quite, I wouldn’t say easy. Nothing is easy. It takes time and effort, but it wasn’t difficult at all to find applicants willing to put their name on an action like this and lead the way. The applicants are really like the plaintiffs.

“If it was a Statement of Claim where we were trying to seek damages, they know the conventional court actions you see in civil court, your plaintiffs are the ones who are driving the action forward. But here, we’re doing a judicial review, so it’s ‘applicants.’ They’re the ones drive the action forward. They’re the ones who are making the application to the court. So I just, you know, make legal arguments on their behalf.
“So we actually had to pare down the number of people who wanted to have their name on the front cover this document because there was more interest then … I didn’t want to burden the court with an unreasonable amount of applicants, because this isn’t like a petition where having, 1000 or 10,000 signatures on it makes it more persuasive. The court, really here is only going to look at, from a legal perspective, at the decision determining whether the decision was reasonable or unlawful. And it doesn’t add any extra weight to the court to see more applicants on the on the front page of the of the action. So that’s why we actually limited it to only these five. And there’s three natural persons, one from Manitoba, as you mentioned, two from Saskatchewan, one from Regina, and one from Saskatoon. I wasn’t sure if the action would proceed in Saskatoon or Regina, and then these environmental groups. So the Saskatchewan Environmental Society has a very long history of advocating for decarbonization of our electrical grid.”
He recently resigned as a director of the SES, saying, “I was a director on the Saskatchewan Environmental Society’s board for a number of years, but I resigned. I didn’t want there to be any conflict of interest if I was representing the Saskatchewan Environmental Society if they chose to pursue this action.”

Common threads
There are some common threads throughout the sworn affidavits which submitted by Wright in support of the originating application seeking an injunction. One of those threads is concern over recent wildfires, which they attribute to anthropogenic climate change (and not other causes like arson or forest management practices, neither of which are mentioned.)
Anxiety over climate change is another common thread. And there’s a rejection of Saskatchewan’s decision to continue burning coal.
The originating application lists the parties as such:
“The applicants KIKÉ DUECK (a minor by their litigation guardian KRIS DUECK), SHERRY OLSON, MATTHEW WIENS are natural persons and residents of Saskatchewan and Manitoba (the “Personal Applicants”). The Personal Applicants share common interests in that they are affected by dangerous climate change, and they all rely on emissions reductions by SaskPower to mitigate the severity of anthropogenic climate change caused by burning of fossil fuels. More information about each of the Personal Applicants is provided in their affidavits.”

The 12 year old from Regina
Clearly there is a page being taken out of the Greta Thunberg playbook in the litigation, with a 12 year old minor as one of the applicants, a minor who, like Greta, skipped school due to climate change concerns and saw stories written about it.
If one of those names seems familiar, that’s because you may have seen it in recent headlines. At age ten, Dueck was the subject of this story carried by the National Post, entitled, “’A protected right’: Saskatchewan family speaks out over pronoun and name changes – Saskatchewan Education Minister Dustin Duncan said teachers won’t be penalized for not following the new policies.”
The Aug. 26, 2023 story starts out by saying, “Kike Dueck loves gym class, especially long-distance running.
“The 10-year-old, who is nonbinary, says everyone at school “is really good about gender,” but knows not all parents are accepting.
“‘There’s a few people in my school that are in the LGBTQ2S+ community but are afraid to tell their parents,’ said Dueck, sitting beside their mom, Dennie Fornwald, in their Regina home.”

Two years later, Dueck was featured in this April 22, 2025 CBC story entitled, “This 11-year-old skipped school over climate anxiety. Here’s how they’re learning to cope – These parents are finding ways to guide their child through that anxiety”
That story started out saying, “When Dennie Fornwald got a call at work on a Friday morning that her 11-year-old hadn’t shown up to school, the Regina woman felt sick to her stomach.
“The school, their friends and family and eventually the police were all out searching for her child.
“Police eventually located the Grade 6 student outside the Saskatchewan legislature.
“Kiké, who uses they/them pronouns, had printed off small flyers about climate change and was handing them out to people.
“‘That day and the days before, I felt so down and hopeless,’ Kiké said. ‘I had read books that action is the best antidote for this. I felt there was nothing else I could do, so I went to the legislature alone.’
“Fornwald was on an emotional roller-coaster that morning.”
And now, at the age of 12, Dueck is once again making headlines as one of the parties to an environmental lawsuit over coal-fired power generation.”

When asked about Dueck filing lawsuits when other kids that age might be playing with Lego, Wright characterized Dueck as “exceptional.”
He pointed to something referenced in the originating application – a study into anxiety in children due to climate issues. In the firm’s other climate action, he noted they filed as a piece of evidence “a report that was done by psychologists who interviewed 1000 youth in Canada and asked them about their outlook on the future, on things like climate. And it was really quite shocking to these psychologists that the amount of concern, and they actually coined this … but the term “eco anxiety” has been regarded as, I don’t know what the right word is. I’m not a medical practitioner, but it’s a real thing that people are experiencing now, related to their thoughts and concerns about the trajectory we’re on and not responding to the real threat that is climate change or overshoot, or, how we’re just exploiting the environment for consumption, profit, what have you.
“I know that my kids think about these types of things, and so I don’t I don’t think it’s unreasonable to see that we’re witnessing more and more young people trying to take action through the courts, whether it was in Montana, like you mentioned, or that it was a case called Juliana in the United States that was went for 10 years before it was finally tossed out. They tried everything they could, but eventually they weren’t successful.
“And in Canada, we’ve got two cases that are also proceeding that were ahead of our case, one of them being the Mather case in Ontario, and another one called the La Rose case in BC. And prior to that, there was even a class action that was attempted in Quebec called the environment Jeunesse case. There, they tried to define a class of people that were anyone under the age of 35 going to suffer disproportionate harms in relation to climate change. So I think the reason you’re seeing more young people do this sort of work is because often they’re below the voting age and they feel like they have no agency. They can’t even participate in the political process to try and guide our future.”

He continued, “The second reason is that they know they’re going to face disproportionate harms because there is a delay period with respect to the carbon pulse that’s put into the atmosphere. The Earth is a large body, and it takes several decades, if not centuries, to reach new equilibrium. So even if we were to magically stop emissions today, which would be a magical thing, we would still see climate change get worse for probably another one to three centuries.
“And so in that way, the benefits we see today from using fossil fuels, because they really are a magical way to store energy. It’s just it’s just something we’ve never experienced as a species before, that we have had the benefit of over the last 200 years. But the consequences of burning that energy is something that is born out into the future, and that’s why you’re seeing more and more young people stand up, because they’re the ones who are going to bear the brunt.”
When asked about children not being allowed to be soldiers below 18, or nor may they vote below that age for the very reason that societies do not consider them to yet have the maturity to stand up as an adult and be a full part of society, Write mentioned driving at 16 and age of consent for sexual activity.
“Are you suggesting then that it’s inappropriate for a 12 year old to be making an application to court?” he countered.
When asked if parents are driving this, and the child’s previous issues that were reported on in the national media, Wright said, “I can tell you that I’ve met Kiké, and I have no concerns that the parents are coercing this person to make their choices and to do their activism. They’re motivated by what they’ve read and learned about on their own.”

“I do think that Kike is exceptional. And I don’t know if they’re Sheldon from the Big Bang Theory, necessarily, but you’re talking here about what goes into what I would say that the discussion of capacity for any individual, because not all 12-year-olds have the same capacity as the other. And just like we would say, not all 85-year-olds have the same capacity, right? So we always try to make a presumption, especially with adults, anyways, a presumption that there is capacity, because to just assume that once you’re 80 years old, you no longer have capacity. Well, that’s agism, right?”
Wright warned against targeting Dueck in online comments, saying, “I’ve seen a bunch of negative social media already on X, targeting Kiké Dueck. And, I mean, I’m starting to consider looking into the Criminal Code and some of the new provisions that were added to talk about using electronic social media or other avenues like that to target minors. Because I think there’s a lot of wild speculation going on about what motivates Kiké to do this or that? Kiké wants to have any kind of, you know, I guess, modeling or following the role model of Greta. And if she did, or I shouldn’t say she if they did, they did, that’s entirely their choice, right? I mean, I okay role models, and I try and emulate them. Why wouldn’t we? That’s what we do as humans. We try and emulate those who we look up to.”

Lawyer warns against targeting the minor being put at the forefront of an action affecting 1100 jobs
When asked about being a lawyer putting that said minor’s name out there, on these public documents, where they will be published by the media, Wright responded that there was a “litigation guardian” listed, the child’s father.
“So if you’re suggesting that I’m doing something unprofessional by, you know, allowing this 12 year old to have a voice, I mean, you go ahead and try that, but I mean, this is an access to justice issue. Minors have a place in our society, and they have a voice, and that voice should be allowed to be aired, and I’m only providing an avenue for them to do that. I’m following all of the court rules that protect the minor. That’s why there’s a minor litigation guardian. That’s why there’s an affidavit from the father, and I don’t see anything untoward there, and I’d happily be able to defend myself if any complaint was made to the Law Society.”
He added, “I’ve met the mother and I’ve met the father online. I’ve talked to them both, and I have done my due diligence to make sure that there is no duress or ulterior motives behind these people. I believe them to be genuine, and I would suggest that anybody who makes speculative comments on social media and tries to attack Kiké do it. They do that at their own peril.”

Dueck said, “Members of my climate club and I then had a long talk with the Minister of the Environment about climate change and sustainability. As a follow up to this project, I organized a small letter writing campaign to the Minister, to stress the importance of the youth perspective on this issue and to show that people are very worried about it.
“It is my understanding that extending the life of coal power plants in Saskatchewan to 2050 is unlawful because the Federal Government has a law that says that coal power plants should be retired by 2030.”
“I am shocked that a provincial government can decide to break the law. Even as a child, I know I have to listen to rules and laws, even when I do not want to. I do not understand why the provincial government would break the law. This is really important to me and will directly impact my future.”

“The Government of Saskatchewan’s overall response to climate change, and specifically this decision to continue using coal past 2030, causes me a lot of anxiety and depression. It has been hard for me to stay optimistic.
“The recent fires in Northern Saskatchewan would not be so bad if it were not for the climate crisis. It is proven that climate change and wildfires are directly correlated.

“It is now my summer holiday. I want to be having fun. However, climate change is making that difficult. For one, I get migraines when there is significant forest fire smoke in the air. Like everyone, I also cannot be outdoors for long in extreme heat, and we know that climate change is increasing the frequency of serious heatwaves.
“I imagine that I will still be alive in 2080, and I am worried that by that time, we will have a much more drastically difficult world to live in than we have now. In my twelve years I have already witnessed things quickly becoming worse due to climate change.
“I do not want to be spending time this summer holiday preparing to go to court over something like this, but the climate crisis is so upsetting and so scary, and I am so upset about my government’s response to it, that I feel I must do something.
“I am motivated to participate in this court case because I believe that the Government of Saskatchewan’s decision to refurbish and extend running the coal power plants in Saskatchewan to 2050 is illegal and wrong. Extending coal power will contribute to the climate crisis and will unquestionably affect me personally.”
